Former president, now Pampanga representative Gloria Macapagal-Arroyo can still be granted bail despite facing a non-bailable electoral sabotage case, according to Senator Miriam Defensor Santiago.
 
Santiago, a former regional trial court (RTC) judge, said that even if the charge is punishable by reclusion perpetua or life imprisonment, bail is still a matter of discretion on the part of the judge.
 
“The grant or denial of an application for bail is dependent on whether the evidence of guilt is strong, which the lower court should determine in a hearing called for the purpose,” she said, citing the 1999 case of People v. Cabral.
 
The senator added that a hearing is mandatory to determine the guilt before bail can be granted to an accused charged with capital offense.
 
In Arroyo’s case, the Pasay RTC, where the electoral sabotage case is to be heard, is required to hold a bail hearing as a matter of due process.
 

“After a bail hearing, the judge should spell out at least a resume of the evidence on which its order granting or denying bail is based. Otherwise, the order is defective and voidable,” Santiago said, quoting the 1991 case of Carpio v. Maglalang.
 
In theory, the function of a bail, which is usually a sum of money in exchange for the release of an arrested person, is to ensure the appearance of the defendant at the time set for trial.
 
Santiago, a former law professor, said that the Rules of Court allows the trial judge to question what form a bail could take.

MANILA, Philippines—As lawyers tangle over where to detain her, former president Gloria Macapagal-Arroyo has reckoned with the possibility of suffering the fate of deposed President Joseph Estrada, who was initially detained in a government facility while on trial for plunder, and is prepared for it — or so says her lawyer-spokesman.
The Pampanga lawmaker, facing charges of electoral sabotage in the Pasay Regional Trial Court, has moved for house arrest, dropping an earlier petition for  hospital arrest in her suite at the St. Luke’s Medical Center in Taguig City.

LEGAZPI CITY, Philippines – President Aquino yesterday received here the Philippine Media Declaration on Climate Change 2011 composed and signed by representatives of four major media organizations in the country.
The declaration will be included in the portfolio that will be presented by the Philippine government to the 17th Conference of Parties (COP 17) to be held in Durban, South Africa from Nov. 28 to Dec. 10.
The declaration was ratified by the Philippine Network of Environmental Journalists (PNEJ), the National Press Club, the Kapisanan ng mga Brodkaster ng Pilipinas, and the Publishers Association of the Philippines, and was submitted to Secretary Herminio Coloma and Albay Gov. Joey Salceda who recommended it to the President.

MANILA, Philippines—A civil action seeking millions of pesos in damages from former President Macapagal-Arroyo in connection with her alleged involvement in the Maguindanao massacre is now in the sala of a Quezon City judge.
The undocketed civil complaint of Ramoncita S. Salaysay et al. against Arroyo was raffled off to Regional Trial Court Branch 104 on Thursday afternoon, court records showed. The 13-page complaint was forwarded to Judge Catherine Manodon on Friday.
A court clerk told the Inquirer that the first hearing had been set for Dec. 9 at 8:30 a.m. It will hear the 15 plaintiffs’ motion that they be allowed to litigate the P15-million damage suit as indigents and therefore be exempt from paying court fees.

In remembrance of the Maguindanao massacre, 23 images taken by documentary photographer Jes Aznar in Mindanao before and after the grisly carnage are being displayed at a multi-media gallery in Makati City.
The exhibit, dubbed “Under the Lord’s Shadow” opened on Wednesday and will run until Dec.14 at the Kanto Artists-Run Space at The Collective in Makati City.
For Aznar, who has been working as a freelance photojournalist and a documentarist in Mindanao for three years, the exhibit is an attempt to share what he believes is the deeper reason behind the killing of 58 people, 32 of them journalists, in Maguindanao on Nov. 23, 2009.

MANILA, Philippines (AP) — The Philippine Supreme Court has ordered vast sugarcane plantation lands owned by relatives of the president to be distributed to thousands of farmers under a government land reform program.
The high court — which has recently been at odds with President Benigno Aquino III — said the 11,115-acre (4,500-hectare) Hacienda Luisita in northern Tarlac province should be turned over to 6,296 farm workers. The ruling, which was made public Thursday, changes a decision last July that gave the workers the option of getting shares of stock in a corporation that runs the plantation instead of land.

Philippine National Police (PNP) chief Director General Nicanor Bartolome on Tuesday categorically denied the authenticity of former President Gloria Macapagal-Arroyo’s mug shots circulating online and published by a newspaper.


"I would like to state for the record that the published pictures are not the authentic mug shot photos of Rep. Gloria Arroyo," Bartolome told reporters.

Fresh from his trip to Indonesia, Philippine President Benigno Aquino III on Saturday night rallied the public behind his administration's effort to prosecute former President and now Pampanga Rep. Gloria Arroyo for alleged electoral sabotage, while promising to accord her due process.

Seventeen months after stepping down from the presidency, Gloria Macapagal-Arroyo on Friday was served an arrest warrant for alleged electoral sabotage.
The Pampanga representative, once dubbed the “Iron Lady of Asia,” was in bed at a 16th-floor suite of St. Luke’s Medical Center in Taguig City, wearing a hospital gown and a neck brace. The serving of the warrant capped a day of swift and unexpected developments.
Senior Supt. James Bucayu of the Southern Police District (SPD) led a battery of policemen in black berets and blue uniforms in serving the warrant. He said Arroyo was calm and had anticipated their arrival, even offered them a smile, and waived her right to hear a reading of her rights by Senior Supt. Joel Coronel.
